University data storage is not represented to be interruption or error free and Georgia State University is not responsible for any data loss or corruption that may occur while using any of the various means of data storage available at Georgia State, regardless of whether the University has been advised that such loss or corruption might occur.  Notwithstanding any language to the contrary, nothing contained on the Georgia State University website or computing network constitutes nor is intended to constitute an offer, inducement, promise, guarantee, warranty or contract of any kind.  
User Conduct
You agree to use the University’s Data Storage only for lawful purposes. You agree not to take any action that might compromise the security of the University’s data storage, render it inaccessible to others or otherwise cause damage to the University’s data storage site or the content stored thereon. You agree not to add to, subtract from, or otherwise modify the content of others, or to attempt to access any content that is not intended for you. You agree not to use the Site in any manner that might interfere with the rights of third parties.  You agree to comply with all applicable Board of Regents and University policies, and all applicable state and federal laws concerning appropriate use of information technology.

Password Security
You are responsible for maintaining the confidentiality of your user identification and password information, and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your use identification and password.

Indemnification
You understand and agree that you are personally responsible for your behavior on University equipment/network systems. You agree to indemnify, defend and hold harmless Georgia State University, the Board of Regents of the University System of Georgia and their respective employees and agents from and against all claims, losses, expenses, damages and costs (including, but not limited to, direct, incidental, consequential, exemplary and indirect damages), and reasonable attorneys’ fees, resulting from or arising out of your use, misuse, or inability to use University data storage or any violation by you of this Agreement.

Disclaimer of Warranties
GEORGIA STATE UNIVERSITY MAKES NO EXPRESS OR IMPLIED WARRANTIES, REPRESENTATIONS OR ENDORSEMENTS WHATSOEVER WITH RESPECT TO THE VARIOUS MEANS OF DATA STORAGE AVAILABE AT THE INSTITUTION INCLUDING, BUT NOT LIMITED TO, STORAGE ON UNIVERSITY COMPUTERS AND UNIVERSITY NETWORKS.  GEORGIA STATE EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE WITH REGARD TO DATA STORAGE FURNISHED OR TO BE FURNISHED VIA ITS SYSTEMS AND EQUIPMENT.  GEORGIA STATE UNIVERSITY DOES NOT WARRANT THAT DATA STORAGE FUNCTIONS WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, OR THAT DEFECTS IN DATA STORAGE WILL BE CORRECTED.  UNIVERSITY DATA STORAGE OPTIONS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

Limitation of Liability
IN NO EVENT WILL GEORGIA STATE UNIVERSITY BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING, BUT NOT LIMITED TO ANY DIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR OTHER INDIRECT DAMAGES ARISING OUT OF (I) THE USE OF OR INABILITY TO USE UNIVERSITY DATA STORAGE, (II) ANY CLAIM ATTRIBUTABLE TO ERRORS, OMISSIONS, OR OTHER INACCURACIES IN THE MEANS OF DATA STORAGE OFFERED BY THE UNIVERSITY, (III) UNAUTHORIZED ACCESS TO, LOSS, CORRUPTION OR ALTERATION OF YOUR DATA, OR (IV) ANY OTHER MATTER RELATING TO DATA STORAGE, EVEN IF GEORGIA STATE UNIVERSITY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF YOU ARE DISSATISFIED WITH THE MEANS OF DATA STORAGE AVAILABLE AT GEORGIA STATE UNIVERSITY, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE STORING DATA ON UNIVERSITY-OWNED OR CONTROLLED EQUIPMENT AND/OR NETWORK SYSTEMS.  BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH STATES, GEORGIA STATE UNIVERSITY’S LIABILITY IS LIMITED AND WARRANTIES ARE EXCLUDED TO THE GREATEST EXTENT PERMITTED BY LAW, BUT SHALL, IN NO EVENT, EXCEED $100.00.
